Terms of Service Update
Please review the updated policy.
(Required)
I've read and agree the new terms of participation.
1. Scope of Agreement and Definitions
In these updated terms, you will find detailed the role and expertise of Hollis Adams - facilitating spaces of dignity and belonging for adults with disabilities.
These terms pertain specifically to the Hollis Adams "Friends" day program and cohorts—a registration-based program—as well as all Hollis Adams spaces, programs, experiences, and opportunities.
● Participant: Refers to the participating adult registered in the program.
● Legal Representative: Refers to a court appointed Guardian or Power of Attorney.
● Support Circle: Refers to any caregivers, family, or direct support professionals involved in the participant's relationship with Hollis Adams.
2. Philosophy of Care and Self-Determination
We build friendship through resilience. We provide a facilitated environment where participants experience the dynamics of social life, which includes camaraderie and fun, but also honesty and occasionally challenging social dynamics.
● Dignity and Agency: Everyone is treated like an adult with their own rights. This means learning to set boundaries and navigating disagreements rather than being sheltered from them.
● Self-Direction: We promote choice and trying new things. This may include experiences at the edge of a participant's comfort zone.
● Assumption of Risk: Participants and their support systems understand that self-determination and community exploration involve a level of inherent risk. By participating, the participant and their Legal Representative acknowledge and voluntarily assume these risks.
3. Facilitation and Ratios
The Hollis Adams facilitator-to-participant ratio is 8:1. We are a social and recreational program, not a clinical or medical health facility.
● Facilitator Role: We provide a schedule of encouraged opportunities, but participants ultimately decide which to pursue. We serve lunch, but participants feed themselves. We navigate accidents and give self-care reminders, but participants toilet themselves.
● One-on-One Support: Participants requiring 1:1 support must bring that support with them. If a participant cannot safely navigate their own movement, toileting, or eating independently, a meeting will be called to explore options for continuing with outside support.
4. Health, Medication, and Safety
● Medication: Hollis Adams does not administer medication. Facilitators may provide verbal reminders for self-administration. For those requiring reminders, a physician-signed "Self Medication Authorization" must be on file.
● Health Monitoring: Facilitators may provide non-clinical observation of health needs (e.g., oxygen tubes, blood sugar levels) but are not trained in medical or therapeutic interventions.
● Mandated Reporting: In accordance with Indiana law, Hollis Adams staff are mandated reporters. We are legally required to report any suspected abuse, neglect, or exploitation of an endangered adult to Adult Protective Services.
5. Behavioral Boundaries and Safety Protocols
● Physical Safety: We cannot allow violence. If a participant has trouble maintaining boundaries, a facilitator will intervene. Initiators of violence will be required to leave for the day and a follow-up meeting will be scheduled.
● Elopement: If the primary caregiver has an expectation that the participant maintains program boundaries, program staff will work to support their goal of remaining on-site. Should a participant leave program space unexpectedly, we will alert the emergency contact and local authorities immediately. For participants with a known history of wandering, we will develop a collaborative plan.
6. Additional Provisions
● Transportation: Participants assume the risks associated with transportation for off-site trips. Participants must follow all vehicle safety rules.
● Media Release: By participating, you have the option to grant or deny Hollis Adams permission to use photographs or video of the participant for promotional purposes.
● Termination of Services: HA reserves the right to terminate services if a participant’s needs exceed the 8:1 facilitation ratio or if a participant poses a
direct threat to the safety of themselves or others.
● Indemnification: To the extent permitted by law, the participant’s support circle and/or Legal Representative agree to indemnify and hold harmless Hollis Adams from any claims arising from the participant’s intentional or negligent actions.
7. Personal Property and Electronics
Hollis Adams is a social environment. While we encourage the use of personal devices for communication or engagement, participants and their Legal Representatives acknowledge the following:
● Liability: Hollis Adams is not responsible for the loss, theft, or damage of personal electronics, jewelry, or other valuables brought into the program.
● Responsibility: Participants are responsible for the care of their own belongings. We strongly recommend that all personal items be clearly labeled with the participant's name.
8. Financial Responsibility and Attendance
● Program Fees: Registration-based program fees are for the reserved "slot" in the cohort. Credits or refunds are not provided for individual absences.
● Pick-up and Departure: Programs conclude promptly at the scheduled time. It is the responsibility of the Support Circle to ensure a timely departure.
9. Transportation and "Open Door" Policy
We recognize that many participants rely on public paratransit services (such as IndyGo
Open Door). Because these arrival times can be unpredictable:
● The Grace Window: Hollis Adams provides a [30-minute] grace window
following the conclusion of the program for participants awaiting public
transportation.
● Communication Requirement: If a public transit vehicle is delayed, the participant or their caregiver must notify Hollis Adams staff as soon as the delay is known.
● Staff Supervision: While HA will ensure the participant has a safe place to wait within the facility during this window, HA cannot provide active 1:1 facilitation or programming during the wait time.
● Excessive Delays: If a public transit provider is consistently more than [60 minutes] late, a meeting will be called with the Support Circle to discuss alternative transportation or a modified schedule to ensure the safety of the participant and the capacity of HA staff.
